What Do I Get from a New York Overtime Lawsuit?

Whether it be a Labor Law case or personal injury matter, a party in a lawsuit seeks “relief” and recovers “damages.”  While the form of relief can vary greatly, the type of damages in a Labor Law case is generally monetary compensation.  But the is not only for all paid overtime, but New York Labor Law also compensates an employee for having to take his or her employer to court.

For instances, New York Labor Law section 663 provides that employees who have had overtime wages improperly withheld from them may be entitled to the following:

All unpaid overtime wages;
Interest on all unpaid overtime wages;
Reasonably counsel fees for having to commence the action;
Costs and disbursements (filing fees, mail postage), for commencing the New York overtime lawsuit; and
Penalties (also known as “liquidated damages,” which is another fee up to 100% of the underpaid wages in addition to the underpaid wages, meaning two-times the unpaid wages).
